Terms of use

1. Who you are agreeing with

This service is operated by an individual resident in Serbia. Once a company is registered, its name, registration number and address will appear here.

In this document, “Music Cartel” means this service, and “we” means the operator named above. “You” means you, whether you have an account or not.

We run more than one app from the same software. They are separate services with separate memberships: an account here is an account here only, and nothing you do on another one of our apps affects this one.

2. What Music Cartel is, and what it is not

Music Cartel is a place to find people near you who want to swap things, and to arrange a swap with them. That is all it is.

We are not a party to any trade. You are not buying from us and we are not selling to you. When two members agree to swap something, that agreement is between those two people; we are not a buyer, a seller, an agent, a broker or a guarantor of it.

We never handle money. Music Cartel lets an offer include a cash amount so that two people can describe an uneven swap accurately. That number is a note about what you have agreed between yourselves. We do not process it, hold it, transmit it, or know whether it was ever paid. Any money changes hands directly between you and the other person, on terms only the two of you set.

We do not check anyone or anything. We do not verify members’ identities, do not inspect items, and do not confirm that an item exists, is owned by the person offering it, is described accurately, is genuine, or is legal for either of you to have. Ratings and karma on Music Cartel are members’ opinions of each other. They are not a check we have carried out and they are not a recommendation from us.

3. Meeting people in person

Music Cartel is built around trades that finish face to face, which means it will suggest people near you and help you arrange to meet. Please take that seriously:

• Meet in a public place, in daylight, with other people around.
• Tell somebody you trust where you are going and when.
• Inspect what you are being given before you hand over what you are giving.
• If something feels wrong, leave. No swap is worth it, and you owe nobody an explanation.

Deciding to meet someone is your decision and your risk. We do not screen members, we are not present, and we cannot control what anyone does. Nothing in this section makes us responsible for another member’s conduct — but nothing in these terms limits our responsibility for death or personal injury caused by our own negligence, or for our own fraud, and we do not attempt to.

4. Your account

• You must be 18 or over to have an account. We ask for your date of birth when you sign up and refuse an account that is too young. Music Cartel is not intended for children, and we will close an account we believe belongs to one.
• One person, one account. Give a real name that the people you meet will recognise.
• Keep your password to yourself. Anything done through your account is treated as done by you.
• Tell us at legal@example.invalid if you think someone else has got into your account.

5. What you may not do

Do not use Music Cartel to:

• offer anything you may not legally own, sell or give away — weapons, drugs, medicines, live animals, stolen goods, counterfeits, or anything whose transfer is restricted where you are;
• harass, threaten, bully, stalk or intimidate anyone, or contact someone who has asked you to stop;
• post sexual content, content involving children, content that encourages violence, or content that attacks people for who they are;
• impersonate somebody else, or lie about what you are offering or who you are;
• post someone else’s personal information — their address, phone number, workplace or photographs of them — without their agreement;
• scrape, bulk-collect or republish other members’ details, including their email addresses, listings or locations;
• attack, overload or probe the service, or try to reach data that is not yours;
• use Music Cartel to advertise something unrelated to trading here.

This list is not exhaustive; it describes the kind of thing we mean. If you break these rules we may remove what you posted, suspend your account or close it.

We cannot currently tell you when we do. Music Cartel sends no email — there is no such thing in the service today — so a removal or a suspension does not arrive as a message: you will find the content gone, or be told your account is suspended the next time you try to sign in. We think you are owed that notice and we intend to send it. Until we can, this is what actually happens, and we would rather say so. If you think we have got it wrong, write to legal@example.invalid and we will look at it again.

6. What you post

What you write and the photographs you upload stay yours. You give us permission to store, display and distribute them for the purpose of running Music Cartel — showing your listing to other members, delivering your messages, and so on — and nothing beyond that. We do not sell what you post and we do not license it to anyone else.

You confirm that you are entitled to post what you post. Do not upload a photograph somebody else took, or a picture of somebody who has not agreed to appear on a public listing.

Deleting a listing removes it from Music Cartel. Messages you have already sent to another member remain in that member’s conversation, because their copy of a conversation is theirs as much as it is yours.

7. What other members post

Listings, posts, messages, photographs and ratings on Music Cartel are made by members, not by us. We do not review them before they appear and we do not endorse them. If you rely on something another member has told you, you are relying on that member.

8. Reporting something

If you see something on Music Cartel that is illegal, or that breaks the rules in section 5, report it. You can use the report control on the item, post, message or profile itself, or write to legal@example.invalid. Tell us what you saw, where it is, and why you think it is a problem.

Every report goes into a queue that we read. We decide, and we act: we can take down a listing, a post, a reply or a message, and we can suspend an account. What we decided is recorded against the report.

What we cannot yet do is tell you. For the same reason as in section 5, neither the person who reported something nor the person affected by the decision is notified of it. Nobody is left without a route: write to legal@example.invalid and we will tell you what happened to a report you filed, or why something of yours was removed.

You can also block another member at any time, without telling us and without giving a reason. Blocking stops them contacting you and takes them out of what you are shown.

9. Availability

Music Cartel is provided as it is. It runs on a small budget and we do not promise it will be available, complete, uninterrupted or free of mistakes, that any particular feature will keep existing, or that you will find a trade. We may change or stop the service; if we shut it down, we will give you reasonable notice and time to get a copy of what you posted — which today means asking us for it, because Music Cartel has no export button.

Keep your own copy of anything you would miss. Nothing here is a backup service.

10. Our responsibility, stated plainly

We are responsible for running the service with reasonable care.

We are not responsible for what members do — for a swap that goes badly, an item that is not what it was said to be, someone who does not turn up, a disagreement about money, or how another member behaves towards you, whether on Music Cartel or in person.

Where the law allows us to limit our liability, we limit it to what is reasonably foreseeable. We do not limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not permit us to exclude — and if any part of this section turns out to be unenforceable, the rest of it still applies.

If you are a consumer, nothing in these terms takes away rights the law gives you and that you cannot agree to give up. Where this document and those rights disagree, those rights win.

11. Ending it

You can leave whenever you like, and you can have your account and what we hold about you deleted. Neither is a button yet. There is no “close my account” control in Music Cartel today: write to legal@example.invalid and we will close it and delete what we hold, by hand, within a month. Our privacy notice describes what deletion can and cannot reach.

We may suspend or close your account if you break these terms, if we are legally required to, or if we stop running Music Cartel. Except where the problem is serious or urgent, we will tell you first and give you a chance to respond.

12. Changes to these terms

If we change anything that materially affects you, we will publish it here and move the version at the top of this page before it takes effect. We cannot email you about it — see section 5 — so this page is the notice, and the version number is how you can tell that what you agreed to has moved. Continuing to use Music Cartel afterwards means you accept the new version. If you would rather not, ask us to close your account.

13. Law and disputes

These terms are governed by the law of Serbia.

If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, and you may bring a claim in your own local courts.

Before anything formal, please write to legal@example.invalid. Most problems are a misunderstanding and we would rather fix it than argue about it.
